Total defence co-ordination between Doctor - Lawyer - Court

MEDEF takes the entire responsibility from the time a Medical Practitioners or Medical Establishments, who are members of MEDEF, receives a notice / summon from District Consumer Disputes Redressal Commission, State Consumer Disputes Redressal Commissions, West Bengal Clinical Establishment Regulatory Commission (WBCERC), National Consumer Disputes Redressal Commission and also Supreme Court of India In such cases MEDEF provides emergency legal support and assistance, appointment of lawyer for appropriate legal advice and counselling, drafting of reply against any complaint and taking appropriate legal steps.

Procedure on receiving a summon from a Judicial Body

• Summon received from a judicial body
• Copy of Summon and Complaint forwarded to Legal Department of MEDEF
• Legal Department of MEDEF forwards the same to the appropriate Advocate and also intimates the Insurance company about such claim.
• MEDEF arranges for a meeting between the concerned Medical Practitioner / Authorised person of a Medical Establishment.
• During the pendency of the Legal Proceeding, MEDEF bears the advocate’s fees on behalf of the Policy Holder. Also the Legal department of MEDEF keeps a thorough monitoring of the proceeding and communicates the same to the concerned Medical Practitioner / Authorized person of the Medical Establishment.
• After the Legal Proceeding is over, the amount of claim (subject to the coverage amount) is reimbursed from the Insurance Company
